1. Purpose and acceptance

These terms of use (“Terms”) govern access to and use of the myheeding.com website and of the free tools made available at tools.myheeding.com — the “Heeding-Diagnostics” carbon diagnostic and the emission-savings calculator (together, the “Tools”) — published by HEEDING CLIMATE SOLUTIONS, a French SAS registered with the Grasse Trade and Companies Register under number 938 468 915, with its registered office at ALPHA Sophia Antipolis, Rue Pierre Laffitte, 06410 Biot, France (“HEEDING”). By accessing the website or using the Tools, you accept these Terms without reservation. If you do not accept them, please do not use the website or the Tools.

2. Access to the Tools

The Tools are provided free of charge, without account creation. HEEDING strives to keep them available but does not guarantee uninterrupted or error-free access, and may modify, suspend or restrict them at any time (including through usage limits designed to prevent abuse).

3. Nature of the results — indicative estimates

The results produced by the Tools (emissions, CO₂e savings, regulatory-compliance trajectories, costs, TCO, potential revenues) are estimates provided for purely indicative and illustrative purposes, based on the data you declare and on public or sector assumptions and factors. Actual values depend on your specific situation (engine compatibility, blend limits, supply, contracts, regulatory and price changes). They constitute neither a certified audit nor legal, tax, financial or accounting advice, and must not be the sole basis for any investment or compliance decision. Have any decision verified by your own advisers. Errors and omissions excepted.

4. AI-assisted content

The written synthesis of the Heeding-Diagnostics report is generated with the assistance of artificial intelligence, framed by HEEDING’s methodology and controls. Despite this framing, AI-generated content may contain inaccuracies; you are responsible for verifying its relevance before any use.

5. Your commitments

You undertake to: (i) provide accurate data that you are entitled to use; (ii) not disrupt the operation of the website or the Tools, nor circumvent their security measures or usage limits; (iii) not carry out systematic or large-scale extraction of data, factors or content (scraping); (iv) not resell or provide the Tools to third parties as a service; (v) comply with applicable law.

6. Intellectual property and report licence

The website, the Tools, their content, trademarks, databases, methodologies and aggregated factors remain the exclusive property of HEEDING or its licensors. HEEDING grants you, over the report generated from your data, a non-exclusive, non-transferable, free licence to use, reproduce and share it for your internal needs and professional exchanges (management, advisers, partners, financiers). Any other exploitation, in particular commercial, or any reuse of the methodology or factors outside the report, requires HEEDING’s prior written consent.

7. Personal data

The processing of personal data relating to the website and the Tools is described in our privacy policy and our cookie policy.

8. Liability

To the extent permitted by law, HEEDING’s liability in connection with the free use of the website and the Tools is limited to proven direct damage caused by HEEDING’s fault, and excludes indirect damage (loss of revenue, profit or opportunity, reputational harm, decisions taken on the basis of the estimates). Nothing in these Terms excludes liability that cannot lawfully be excluded (including wilful misconduct or gross negligence).

9. Changes to these Terms

HEEDING may amend these Terms at any time; the applicable version is the one published on the website at the time of your use. The last-updated date appears at the top of the page.

10. Governing law and jurisdiction

These Terms are governed by French law. Failing amicable resolution, and subject to applicable mandatory provisions, any dispute relating to their interpretation or performance falls within the jurisdiction of the competent courts within the remit of the Aix-en-Provence Court of Appeal.
